The Foundation of DBC-Free Practices was established on September the 18th 2007 during a meeting of psychiatrists and psychotherapists.
The Foundation aims:
· To monitor and protect the privacy of patients and clients of psychotherapists and psychiatrists
· To protect and uphold the medical private code of psychotherapists and psychiatrists
· To look after the interests of psychotherapists and psychiatrists who advocate an endurable guarentee of confidentiality as the essential condition for psychotherapy
· To represent and act as litigant to those interested ranging under the objective of the Foundation. This embodies professional and judicial parties, including disciplinary right
· To encourage and maintain the independent professional practice of psychotherapists and psychiatrists in regard to Health Insurance Providers and Public Bodies as amongst others realized in DBC-free practices.
The Foundation aspires to DBC-free practicing of fellow professionals whose professional code does not allow them to work according to the DCB system, wherefore these practices guarantee the privacy of patients. Hereby we feel that the fundamental condition of psychotherapeutic and psychiatric treatment, confidentiality, remains unimpaired.
By not cooperating in handing over our patient’s vulnerable personal information to both authorities and insurance companies, we are – from January 1 2008 onwards - liable for punishment. We could receive senior official fines and - in addition - be persecuted on account of an economic offense. In fact it comes down to a ‘Berufsverbot’.
A team of specialized lawyers is acting on behalf of the Foundation. Currently, a lawsuit is running at the Court of Appeal. If we are not proven right, we will carry on to the European Court of Human Rights in Strassbourg.
The court procedure doesn’t come cheap. It might be possible to join forces on an International scale, especially in relation to procedures at the European Court in Strassbourg.
